fdc Subscription Terms And Conditions

Firearms Direct Club User Agreement and Subscription Terms

This User Agreement and Subscription Terms (“Agreement”) is entered into by and between you (“User” or “Member”) and Firearms Direct Club (“FDC,” “Company,” “we,” “us,” or “our”). By accessing or using our website (the “Site”) or subscribing to our membership service, you agree to be bound by the terms and conditions outlined in this Agreement. If you do not agree to this Agreement, you may not use the Site or services.

“Eligibility”

You must be at least 18 years of age and legally permitted to purchase and/or sell firearms in accordance with all applicable laws and regulations in your jurisdiction to use the Site for firearm transactions. By using this Site, you represent and warrant that you meet these eligibility requirements.

There is no age restriction for a static FDC membership for the purpose of purchasing non-regulated items. However, all state and federal laws apply regarding age-restricted item purchases.

“Nature of Services”

Firearms Direct Club serves as an online platform that connects sellers of firearms and related accessories with potential buyers. The Company does not sell, manufacture, ship, or handle any products listed by users on the Site. All transactions, communications, and agreements regarding the sale or purchase of firearms occur directly between the sellers and buyers.

“Subscription Terms and Fees”

FDC offers two subscription tiers and a lifetime access tier:

  1. Monthly Subscription
  • Billed every 30 days
  • Monthly billing occurs at 2:00AM CST
  • Eligible for promotional discounts
  1. Annual Subscription
  • Billed every 365 days
  • Yearly billing occurs at 2:00AM CST
  • Not eligible for additional promotional discounts
  • No free trial period available

All subscription payments are processed through third-party payment processors, which are not owned or controlled by Firearms Direct Club.

Payments are processed via Authorize.Net in compliance with PCI standards.

“Free Trial”

Free trials are available for monthly subscriptions.

A valid credit card is required for the free trial and will be pre-authorized.

If the subscription is not canceled within two days, the card will be charged the full subscription rate at 2:00AM CST on the 3rd day.

The trial is implemented as a “3 Day Trial” but advertised as a 2 Full Day trial to allow for afternoon accounts being created and not charged until after 2 full days have passed between signing up and being charged.

Annual and Lifetime subscriptions are not eligible for free trials.

“Auto-Renewal”

Auto-renewal is enabled by default for all subscription tiers. For as long as a member is in good standing and allows the renewal of their subscription, FDC will not increase the rate of the subscription for the life of the subscription. This includes and covers existing members when FDC has price increases to potential new members.

  • For monthly subscriptions, renewal occurs every 30 days.
  • For annual subscriptions, renewal occurs once per year on the anniversary date.

“Cancellation”

Members can cancel their subscription at any time through the Account Management tab in the user portal on firearmsdirectclub.com.

Cancellations are effective at the end of the current billing period.

No refunds are provided for partial terms of service.

Once an account is cancelled, the original membership rate cannot be reinstated. Please realize this before cancelling.

Lifetime memberships do not expire once created.

“Account Sharing”

Subscriptions are limited to one household only.

Family members residing at the same address may share an account.

Sharing accounts or using accounts to facilitate FDC access outside of the household is strictly forbidden, as is using FDC to ship products to others.

Two-factor authentication (2FA) is required on all accounts to enforce this policy.

“Data Retention and Privacy”

Member data is retained upon cancellation unless explicit removal is requested.

FDC does not sell member data to any outside parties for marketing or other purposes.

“Access and Usage”

All members have equal access to distributor pricing and services.

There are no limitations on the number or value of orders a member can place.

“Geographic Restrictions”

FDC memberships are available to residents of the United States only.

FDC Memberships are not available in Hawaii or Alaska due to shipping restrictions.

“Third-Party Services”

Firearms Direct Club integrates third-party services for payment processing and shipping facilitation. These third-party companies operate independently of Firearms Direct Club, and we make no warranties or representations regarding their services.

“User Responsibilities”

You agree that you are solely responsible for ensuring that your use of the Site and any transactions conducted through it comply with all applicable federal, state, and local laws. This includes but is not limited to background checks, legal ownership of firearms, ammo, accessories, proper licenses, and any other legal requirements associated with the buying or selling of firearms and related articles.

“Prohibited Activities”

  • Engaging in illegal transactions or violating any applicable laws, including firearms laws.
  • Listing products or engaging in transactions that involve stolen, prohibited, or counterfeit firearms or accessories.
  • Using the Site to engage in any form of fraudulent, deceptive, or misleading behavior.
  • Providing false or misleading information in your profile or listings.
  • Sharing protected pricing information through any physical or digital means.
  • Using the service to ship items to individuals other than the account holder or authorized household members is strictly prohibited. This includes:
    • Shipping to friends or extended family members not residing at the account holder’s address
  • Violation of these shipping restrictions will result in:

    1.  Immediate suspension of shipping privileges
    2. Potential termination of membership without refund
    3. Possible reporting to relevant authorities if illegal activity is suspected

    FDC actively monitors shipping patterns and addresses to enforce these policies.Multiple shipments to different addresses or unusual shipping patterns may trigger an account review.

“Disclaimers”

Firearms Direct Club provides the Site on an “AS-IS” and “AS AVAILABLE” basis without warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Site will be free from errors, interruptions, or security breaches.

“Indemnification”

You agree to indemnify, defend, and hold harmless Firearms Direct Club, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees and court costs) arising out of or in any way connected with:

  • Your access to or use of the Site.
  • Any claims, disputes, or legal proceedings arising from the purchase, sale, or use of any firearm or related accessory through the Site.
  • Your violation of any applicable law or regulation, including but not limited to federal, state, or local firearms regulations.
  • Any transaction or dispute between you and a third-party service provider, including but not limited to payment processors and shipping companies.
  • Any breach by you of this Agreement or any warranty or representation you make under this Agreement.

“Limitation of Liability”

To the maximum extent permitted by law, Firearms Direct Club will not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from or relating to this Agreement, your use of the Site, or any products sold through the Site, including but not limited to damages for lost profits, loss of data, or other intangible losses.

“Termination”

Firearms Direct Club reserves the right, in its sole discretion, to suspend or terminate your membership or access to the Site at any time for any reason, including but not limited to a breach of this Agreement or violation of any applicable law.

FDC reserves the right to terminate subscriptions without refund for the following reasons:

  • Sharing of accounts outside the household.
  • Selling access to FDC accounts.
  • Sharing protected pricing information through any physical or digital means.

“Governing Law”

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.

“Dispute Resolution”

Any disputes arising out of or related to this Agreement or the Site shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will take place in Jacksonville, Florida, and the decision of the arbitrator shall be final and binding on both parties.

FDC commits to addressing disputes in a timely manner.

“Amendments and Changes to Terms”

Firearms Direct Club reserves the right to modify or amend this Agreement at any time. Any changes will be posted on the Site, and continued use of the Site following any changes constitutes acceptance of the revised terms.

Any changes to pricing or subscription terms will be communicated via email and pricing changes will not apply to existing customers for as long as they maintain an active subscription:

“Contact and Communication”

By providing your contact information (including but not limited to email addresses, phone numbers, or mailing addresses) through the Site, you consent to being contacted by Firearms Direct Club or other users of the Site regarding transactions, services, or any other relevant communications. You agree that we, or any authorized third party, may contact you using any of the contact information you provide for the purposes of customer service, transactional updates, or marketing messages.

You may opt-out of certain communications by following the instructions provided in those communications or contacting us directly. However, we may still send you essential transactional or administrative messages, from which you cannot opt out.
